On December 3, 2015, the USCIS issued a reminded to all EB-5 Regional Centers that they must file a completed I-924A fiscal year 2015. The deadline for filing is December 29, 2015.
All approved Regional Centers as of September 30th of any given calendar year are required to file the -924A by 29th of December of that same calendar year. The I-924A is used to demonstrate and determine the continuing eligibility as a designated Regional Center.
If a Regional Center fails to file the form as required, the USCIS will issue a Notice of Intent to Terminate and may follow up with a Notice of Termination lacking adequate mitigation for failure to file.
Under ordinary circumstances, there are essentially two reasons why the USCIS will terminate their authorization of a Regional Center. The first is failure to file any required information, such as the I-924A. The second is evidence that the Regional Center has failed to actually promote economic growth.
We encourage Regional Centers to file sooner rather than later.
